Research For You App - Terms and Conditions
You, the user of the Research For You App (App), confirm your acceptance of these App Terms and Conditions of use (“App Terms”) as a binding contract between yourself and SMO Services Ltd for MAC Clinical Research. If you do not agree to these App Terms, you must immediately uninstall the App and discontinue its use. These App Terms should be read alongside App Privacy Policy.
This App is offered for your own personal use without cost, you should be aware that you are not permitted copy, modify the App, any part of the App or SMO Services Ltd or MAC Clinical Research’s trademarks in any way. You are not permitted to extract or attempt to extract the source code of the App or make derivative versions. The App, and all related intellectual property rights, including but not limited to: trademarks, copyrights and database rights remain the property of SMO Services Ltd and MAC Clinical Research.
Related Terms
Depending on the version of the App you have downloaded, these App Terms incorporate Apple’s or Google Android’s terms and conditions and privacy policies (“Platform Terms”). If there is any conflict between these App Terms and the Platform Terms then these App terms will prevail.
Use of the App
You must be at least 18 years of age and resident in the UK to use the App.
SMO Services Ltd hereby grants you a non-exclusive, non-transferrable, revocable licence to use the App for your personal, non-commercial use and only on Apple or Android devices.
SMO Services Ltd is committed to ensuring that the App is as useful and efficient as possible. For this reason, SMO Services Ltd reserves the right to make changes to the App at any time and for any reason. The App is currently available on Android and Apple iOS. You should note that the requirements for both systems may change and you may need to download the updates if you want to continue to use the App. SMO Services does not promise that it will always update the App so that it is relevant to you and/or will work with the version of Apple iOS/Android you have installed on your device. However, you promise to always accept updates to the App when offered to you. SMO Services may wish to stop providing the App, and may terminate use of it at any time without giving notice of termination. Unless we tell you otherwise, upon termination, (a) the rights and licenses granted to you in these App Terms will end; (b) you must stop using the App, and (if needed) delete the App from your device.
Conduct when using the App
You agree to comply with all applicable laws when using the App. You agree not to use the App in any way that:
- Is unlawful, illegal or unauthorised, or which promotes or encourages illegal activity including but not limited to copyright infringement or computer misuse;
- Is obscene, offensive, upsets others or is defamatory of any person;
- Promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
- Infringes any copyright, database right or trademark of any other person;
- Is likely to disrupt the services of SMO Services Ltd or MAC Clinical Research in any way;
- Impersonates someone else or uses someone else’s account;
- Spams other users of the App;
- Reverse engineers the App;
- Develops third party apps that interact with the App.
Indemnification
You agree to indemnify SMO Services Ltd and MAC Clinical Research for any breach by you of these App Terms. SMO Services Ltd and MAC Clinical Research reserves the right to control the defence and settlement of any third-party claim, for which you indemnify SMO Services Ltd and MAC Clinical Research under these App Terms and you will assist us in exercising such rights
No Promises
SMO Services Ltd provides the App on an ‘as is’ and ‘as available’ basis without any promises or representations, express or implied. In particular, SMO Services Ltd does not warrant or make any representation regarding the validity, accuracy, reliability or availability of the App or its content. As the clinical trials MAC Clinical Research recruits for change frequently, content on the App may occasionally be out of date, SMO Services Ltd makes no commitment to update the App.
Downloading the App, registering with MAC Clinical Research and providing your details does not guarantee that you will be eligible to participate in a clinical trial.
Security
The App stores and processes personal data that you have provided in line with the Privacy Policy and General Data Protection Regulations. It is your responsibility to keep your phone and access to the Research For You app secure.
Data
If you are using the App outside of an area with Wi-Fi you should remember that the terms of agreement and any applicable charges with your mobile network provider will still apply. By using the App you are accepting responsibility for any such charges.
Reliance on Information
The App is intended to provide general information about clinical trials run at MAC Clinical Research should not be considered as a substitute for medical advice. The App is in no way to be considered or used as a replacement for professional medical advice from an appropriate health professional such as your GP.
Exclusion of Liability
To the fullest extent permitted under the applicable law, in no event shall SMO Services Ltd or MAC Clinical Research be liable to you in respect of use of the App and/or be liable to you for any direct, indirect, special or consequential damages, including, but not limited to, damages for loss of goodwill, lost profits, or loss, theft or corruption of your information, the inability to use the App, Device failure or malfunction. SMO Services Ltd and/or MAC Clinical Research shall not be liable even if it has been advised of the possibility of such damages, including but not limited to damages cause by error, omission, interruption, defect, failure of performance, unauthorised use, delay in operation or transmission, line failure, computer virus, worm, trojan horse or other harm.
Nothing in these App Terms shall exclude or limit the liability of SMO Services Ltd for death or personal injury caused by its negligence or for fraud or any other liability to the extent the same may not be excluded or limited as a matter of law.
In the event that the applicable law does not allow the exclusion of certain promises and/or exclusion of liability for direct, indirect, consequential or other damages, in no event shall SMO Services Ltd liability arising under or in connection with these App Terms and your use of the App exceed £50 (fifty pounds).
General
These App Terms shall be governed by the laws of England and Wales and the parties submit to the exclusive jurisdiction of the courts of England to resolve any dispute between them arising under or in connection with these App Terms.

General Information About Clinical Trials
What is a Clinical Trial?
Clinical trials are an essential part of medical research that are used to test new drug products, as well as existing medications, to help develop new treatments. The medical knowledge that clinical trials aim to determine can range from how the human body absorbs a drug, how the drug may react to other medications, and if the drug is affected by food.
Will I be paid to take part?
This depends on the individual study. For some studies there will be an inconvenience payment based upon the sacrifice of time you have made. Other studies may not provide payment but could offer the opportunity to be part of the first set of patients to trial a new medication that could relieve you of your symptoms.
Whether the study offers payment or not, taking part in the trial won’t cost you a penny as we will either provide transport to or from our clinics, or reimburse your travel expenses.
Please be aware that simply by registering for a clinical trial, SMO Services Ltd and MAC Clinical Research do not guarantee you will be able to participate in it.
How long do clinical trials last?
Each study is unique, and the frequency and duration of the visits will vary. A typical study will have between 5-10 visits and the duration of these visits can range from 30 minutes to several hours however, some longer visits are possible such as overnight stays.
In the event that you are selected to take part on one of our clinical trials, please be aware that these sometimes finish earlier than anticipated for a variety of reasons.
